NOTICE TO THE PUBLIC OF
THE PASSAGE AND ENACTMENT
OF AN ORDINANCE

At the regular meeting of the St. Helena Parish Police Jury held on July 24, 2018, the St. Helena Parish Police Jury passed and enacted the following ordinance which will take effect thirty (30) days after publication in the St. Helena Echo, to-wit:

ORDINANCE NUMBER 309 OF 2018
"AN ORDINANCE TO ABANDON AND REVOKE THE PUBLIC SERVITUDE AND RIGHT OF WAY FOR TWIN OAKS DRIVE LOCATEDIN THE 5rH WARD OF ST. HELENA PARISH, LOUISIANA OFF OF LOU SIANA HIGHWAY 441"

WHEREAS, by written document or documents submitted to the St. Helena Parish Police Jury from the Estate of Sherry Lynn Fugler, with this estate being declared to be the sole and only owner of all of the property served by and/or burdened by the public servitude and right of way for Twin Oaks Drive and herein sought to be abandoned by the St. Helena Parish Police Jury as a public roadway and the said estate's representatives having certified that there are no other property owners that are served by or burdened by or have a potential to utilize any portion of Twin Oaks Drive which roadway is proposed to be abandoned in its entirety and this land owner through her representatives having specifically requested that the St. Helena Parish Police Jury abandon all of Twin Oaks Drive from its inception at the intersection of Louisiana Highway 441 to its conclusion being a roadway 15 feet in width by 3,806 feet in length;

WHEREAS, based open the information provided to the St. Helena Parish Police Jury, Twin Oaks Drive is no longer needed for public purposes and should be abandoned; and

WHEREAS, the abandonment of Twin Oaks Drive as a public road way will benefit the St. Helena Parish Police Jury by reducing its obligation to maintain: this said roadway that is no longer needed for public purposes such that now _and in the future there shall be no parish work on any portion of Twin Oaks Drive.

THEREFORE BE IT ORDAINED by St. Helena Parish Police Jury the governing authority of St. Helena Parish, Louisiana as follows:

That the dedication for public use of Twin Oaks Drive, 5th Ward of St. Helena Parish, Louisiana is hereby declared to be no longer needed for public purposes and without any public utility and as a result Twin Oaks Drive is hereby abandoned as a public roadway by the St. Helena Parish Police Jury, now and forever. Accordingly, the property formally burdened by the parish road servitude and right of way for Twin Oaks Drive is hereby abandoned and revoked and shall be the exclusive property of the Sherry Lynn Fugler Estate. All parish signage shall be removed from the roadway herein and hereby abandoned.

The St. Helena Parish Police Jury on the adoption of this ordinance, shall not be responsible for the upkeep nor the maintenance of any portion of Twin Oaks Drive, the said Twin Oaks Drive having been hereby abandoned and no employee of the St. Helena Parish Police Jury, no equipment of the St. Helena Parish Police Jury and no material belong to the St. Helena Parish Police Jury shall be expended upon or used to benefit the abandoned Twin Oaks Drive.

BE IT FURTHER ORDAINED by St. Helena Parish Police Jury that this ordinance shall take effect upon its promulgation.

The above and foregoing ordinance having been duly submitted to the St. Helena Parish Police Jury in writing; discussed at a duly scheduled and noticed public hearing; after motion and second was submitted to the official vote of the St. Helena Parish Police Jury as follows:

BE IT FURTHER ORDAINED that this ordinance is a St. Helena Parish Police Jury Road Abandonment ordinance and shall take effect thirty (30) days after being promulgated as provided by law, being by publication of a copy of this ordinance with notice of its passage one (1) time in the St. Helena Echo, the official journal of the St. Helena Parish Police Jury.

WHEREUPON the above and foregoing ordinance was declared duly adopted on this day of July, 2018, at Greensburg, Louisiana.
